Terms of Use

These Terms of Use ("Terms") govern your use of nickbaxter.com and its associated services, accounts, content, commerce features, member areas, professional resources, educational materials, and other functionality (collectively, the "Site").

By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Site Owner

The Site is operated by Nick Baxter ("I," "me," "my," or "Nick Baxter").

2. Intellectual Property

Unless otherwise indicated, the artwork, tattoo photography, paintings, drawings, miniature artwork, photographs, videos, educational materials, written content, graphics, branding, website content, and other original materials displayed through the Site are owned by or licensed to Nick Baxter and are protected by applicable intellectual-property laws.

Access to the Site does not transfer ownership of that content.

Except where expressly permitted, content may not be reproduced, republished, distributed, sold, commercially exploited, or used to create derivative commercial material without permission.

Ordinary personal viewing of publicly available Site content is permitted.

Purchasing an artwork, print, digital resource, video rental, workshop, or other product does not transfer copyright or other intellectual-property rights unless expressly stated in writing.

3. Accounts

Some features require an account.

You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account.

You agree to provide reasonably accurate information and not to impersonate another person or create accounts for fraudulent or abusive purposes.

I may suspend or terminate accounts reasonably believed to be involved in fraud, unauthorized access, abuse, violation of these Terms, or activity that threatens the Site or other users.

4. Member and Verified Professional Access

Some resources may be restricted to registered Members or Verified Pros.

Verified Pro status is granted administratively according to the site's professional-verification process. It is separate from payment.

Purchasing a Pro-only product does not independently establish or grant Verified Pro status.

Professional access may be removed if eligibility is withdrawn, an account is being misused, or these Terms are violated.

5. Products and Availability

The Site may offer products and services including:

• original artwork;
• limited editions;
• prints and merchandise;
• digital products;
• educational resources;
• workshops;
• events;
• professional resources;
• services; and
• time-limited access to protected video or other digital media.

Product appearance may vary somewhat from screen representations because displays, photography, printing, materials, and handmade processes can differ.

Publication of a product page does not guarantee current availability. Sold-out or unavailable products may intentionally remain publicly visible as part of the historical archive.

Prices, availability, editions, capacities, and offerings may change where permitted by law.

6. Orders and Payments

Purchases are processed through Stripe, the site's payment processor. Payment-card details are entered into and handled through Stripe's payment flow rather than being stored by this website.

You agree to provide accurate information reasonably required to process and fulfill your order.

An order is not considered successfully paid merely because a browser reaches a confirmation or return page. Payment must be confirmed through the authorized payment system.

I reserve the right, where permitted by law, to refuse or cancel an order because of fraud, pricing or inventory errors, duplicate transactions, product unavailability, capacity limits, technical errors, or other legitimate reasons. If payment has already been collected for an order that cannot be fulfilled, an appropriate refund will be provided.

Applicable shipping charges and taxes may be added during checkout.

7. Originals, Limited Editions and Inventory

Original artworks may be unique objects with a quantity of one.

Limited editions may have a fixed inventory or edition size.

Completing payment for the final available unit may cause an offering to become sold out. The Site may reject subsequent attempts to purchase unavailable inventory.

Sold-out listings may remain visible as archival records and should not be interpreted as offers of currently available inventory.

8. Digital Products

Digital products are licensed or made accessible according to the terms stated with the applicable offering.

Unless expressly stated otherwise, purchasing digital content grants you personal access or use and does not transfer ownership of the underlying copyright.

You may not redistribute, resell, publicly reproduce, publish, share access credentials for, or commercially exploit protected digital materials except with express permission.

9. Time-Limited Video Rentals

Certain prerecorded videos may be offered to eligible Verified Pros as time-limited rentals.

When your viewing period starts. Completing payment does not start your viewing period. Your rental begins the first time you successfully start playing the video from your own account. From that moment, you have the viewing period stated for that particular rental, and access ends automatically when it runs out. The record kept on the site's server is the authoritative record of when your rental started and when it ends; changing the time on your device, reloading, or an interruption in the site or in a provider's service does not change it.

Unless the applicable offer states otherwise:

• payment is a one-time charge, not a subscription;
• the rental applies only to the specified video;
• you may stream the video repeatedly during your viewing period;
• access automatically ends when that period expires;
• the rental does not grant a permanent download;
• purchasing another rental after expiration begins a new viewing period; and
• access may additionally require the account to retain current Verified Pro status.

There is no start-by deadline. A rental you have paid for but never started remains available to start at any time, and your viewing period does not begin until you first play it.

A rental is for the purchasing account only. It may not be shared, transferred, resold, redistributed, or publicly exhibited unless a particular offering expressly permits it.

Attempts to bypass access controls, copy protected media URLs, redistribute protected content, or provide unauthorized access to others are prohibited.

10. Workshops, Events and Services

Workshop, event, critique, educational, or other service purchases may be subject to dates, capacity limits, eligibility requirements, preparation requirements, or other terms displayed with the particular offering.

Purchasing a place does not permit unauthorized resale or transfer unless expressly allowed.

Additional event-specific or service-specific terms may be displayed before purchase.

Workshops, videos, ebooks, downloadable resources, critiques, Journal writing, and other educational or professional resources are provided as educational and informational material. They do not guarantee any particular artistic, professional, business, financial, client, or tattoo-healing result, and they are not individualized medical, legal, financial, or other regulated professional advice. 11. Shipping and Physical Fulfillment

Physical products requiring shipment will be sent to the shipping address supplied with the order.

Customers are responsible for providing an accurate deliverable address.

Domestic orders. Automated checkout on this Site collects shipping addresses within the United States. Domestic orders are shipped using ordinary carrier services, and each shipment includes the carrier's standard level of coverage, if any. Delivery does not require an in-person signature unless that is arranged in advance.

Additional insurance and signature delivery. Additional shipping insurance — including coverage up to the full purchase value of the item — or signature-required delivery can be arranged if you request it before your order ships. Any additional carrier, insurance, or special-delivery charges arising from such a request are your responsibility.

International orders. International orders for physical goods are welcome, but they are not completed through automated checkout, because shipping cost varies according to destination, item, carrier, service level, insurance, and any additional delivery requirements. To order internationally, submit an international order request with the item and your shipping address. The order is then reviewed individually, the applicable shipping charges are determined, and you are asked to complete payment afterwards. Submitting a request does not charge you and does not create a completed paid order.

International charges. You are responsible for applicable international shipping charges and for any customs duties, import taxes, brokerage fees, tariffs, or other charges imposed by the destination country, carrier, or other authority. Some of those charges may not be known or collected by Nick Baxter at the time of payment and may be payable separately by the recipient. An international order is not shipped until the purchase price and the charges collected directly by Nick Baxter have been paid.

Shipping damage. If an item arrives damaged, report it promptly after delivery with photographs of the item, the shipping container, the packaging materials, and the visible damage, so the damage can be assessed and, where applicable, a carrier claim made.

12. Returns, Cancellations and Refunds

Refund, return, cancellation, and exchange eligibility varies according to the type of product or service. The policy for each kind of purchase is stated below and is also summarized at the time of purchase; any product-specific terms displayed at the time of purchase form part of that transaction.

Payment-processing fees. Where a refund is issued because you cancelled, returned an item, or otherwise requested a discretionary refund, any payment-processing fees charged to Nick Baxter that the payment processor does not return are deducted from the refunded amount. That deduction is never applied where the refund arises from an order that cannot be fulfilled, an incorrect item supplied, qualifying shipping damage, a duplicate charge, or an unresolved technical problem.

Original artwork. Sales of original artwork are final, except where the work arrives damaged or an incorrect item was supplied. Shipping damage must be reported promptly after delivery, with photographs of the artwork, the shipping container, the packaging materials, and the visible damage.

Workshops, classes and events. Cancelling more than 7 days before the scheduled date is eligible for a refund of the amount paid, less any payment-processing fees charged to Nick Baxter that the payment processor does not return. Cancelling 7 days or less before the scheduled date is non-refundable, and no-shows are non-refundable. A registration may be transferred to another person only where the transfer is requested and approved by Nick Baxter in advance. If Nick Baxter cancels or reschedules an event, you may choose a full refund of the amount paid, with no processing-fee deduction, or a transfer to a rescheduled date.

Downloadable digital products. Downloadable digital products are non-refundable after purchase, except in the case of a duplicate charge, delivery of an incorrect product, or a genuine technical problem that prevents access and cannot reasonably be resolved. If purchased digital content later becomes unavailable for reasons unrelated to your own actions or a violation of these Terms, an appropriate refund may be issued.

Time-limited video rentals. Before you first start playing it, a rental is refundable, less any payment-processing fees charged to Nick Baxter that the payment processor does not return. After first playback, a rental is non-refundable, except where a genuine technical failure of the Site or of the video-delivery service prevents reasonable access and cannot be resolved; in that case no processing fee is deducted.

Ordinary physical merchandise. This applies to ordinary physical merchandise such as shirts and other apparel, patches, stickers, ordinary prints, limited-edition merchandise where otherwise eligible, and similar physical Shop merchandise. It does not replace or modify the policies stated above for original artwork, workshops, classes and events, downloadable digital products, or time-limited video rentals.

Ordinary physical merchandise may be returned within 14 days of delivery if it is unused, unworn, unwashed, and in its original condition.

For customer-requested returns, the purchaser is responsible for return shipping. Original shipping charges are non-refundable.

Refunds for customer-requested returns are subject to deduction of payment-processing fees actually charged to Nick Baxter and not returned by the payment processor.

If an item arrives damaged, defective, or incorrect, please contact Nick Baxter promptly so the issue can be resolved. Qualifying returns resulting from damage, defect, or an incorrect item are not subject to the customer-requested processing-fee deduction.

Exchanges are not guaranteed. If an exchange is desired, contact Nick Baxter to determine whether the requested replacement is available.

Customized or personalized merchandise. Customized or personalized merchandise is final sale unless it arrives damaged, defective, or incorrect. This exception applies only to merchandise specifically customized or personalized for a purchaser, and does not change the policy that applies to ordinary merchandise, limited-edition merchandise, original artwork, commissioned artwork, workshops, digital products, or rentals.

International orders. An international order that has been quoted but not yet paid may be withdrawn at any time at no cost. Once an international order has shipped, the sections above apply to the item itself; international shipping charges, customs duties, import taxes, and similar third-party charges are not refundable.

Nothing in these Terms eliminates refund, cancellation, warranty, or consumer rights that cannot legally be waived.

Where a refund results in revocation of a digital entitlement, access to the corresponding protected content may end when the refund is processed.

13. User Comments and Contributions

Where the Site permits comments or other user-submitted material, you remain responsible for what you submit.

You may not submit content that is unlawful, threatening, harassing, fraudulent, defamatory, infringing, malicious, invasive of another person's privacy, or designed to compromise the Site.

You represent that you have the rights necessary to submit material you post.

By intentionally submitting material for public display, you grant Nick Baxter a non-exclusive license to host, reproduce, and display that material as reasonably necessary to operate the relevant Site feature.

This does not transfer ownership of your contribution to Nick Baxter.

I may moderate or remove contributions reasonably believed to violate these Terms or applicable law.

14. Prohibited Uses

You may not:

• attempt unauthorized access to accounts, databases, administrative systems, or protected content;
• bypass or defeat authentication, professional verification, payment, entitlement, or media-access controls;
• scrape or systematically extract protected or non-public information;
• introduce malware or intentionally interfere with operation of the Site;
• use another person's account without authorization;
• use the Site to commit fraud or unlawful activity;
• infringe intellectual-property or privacy rights;
• redistribute protected educational or media content without authorization; or
• use automated systems in a manner that materially disrupts the Site or circumvents reasonable access controls.

Ordinary use by legitimate search engines and ordinary browser functionality is not prohibited.

15. Third-Party Services and Links

The Site may use or link to services operated by third parties.

Those services may have their own terms and privacy practices. I am not responsible for the independent content, availability, security, or practices of third-party websites or services outside my control.

16. Site Availability

I may modify, maintain, suspend, or discontinue portions of the Site when reasonably necessary.

Continuous or error-free availability cannot be guaranteed.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and its general informational content are provided on an "as is" and "as available" basis without warranties that are not expressly stated.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Nick Baxter will not be liable for indirect, incidental, special, exemplary, or consequential losses arising solely from use of or inability to use the Site.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising from your unlawful misuse of the Site, infringement of another person's rights, or material violation of these Terms.

20. Privacy

Use of personal information associated with the Site is addressed in the Privacy Policy available at /privacy-policy.

21. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to applicable law, disputes arising from these Terms or use of the Site will be handled in courts having appropriate jurisdiction in Travis County, Texas.

22. Changes to These Terms

These Terms may be revised as the Site, Services, offerings, or applicable requirements change.

The current version will be identified by the "Last updated" date displayed on this page.
